The Trump administration can drop an appeal of a court decision that vacated the Department of Transportation’s Biden-era rule aimed at limiting highway emissions, the Fifth Circuit said Tuesday.
“Upon further consideration, DOT no longer wishes to pursue appellate review of the district court’s decision in this case,” the agency said in its unopposed motion filed Feb. 3 with the US Court of Appeals for the Fifth Circuit.
